These terms of use (“Terms of Use”) apply to the website owned by HOTEL SAN GIACOMO – FIVE SEASONS SRL (hereinafter the Company), located at the address www.hotelsangiacomo.com.

By using the site, the user accepts these terms of use; if the user does not accept them, he/she should refrain from using the site.

The Company reserves the right to modify, add to or remove the provisions in these Terms of Use at its own discretion and at any time. The user is required to regularly check the Terms of Use for any changes. Use of the site following the posting of changes will indicate acceptance of the changes by the user. Subject to compliance with these Terms of Use, the Company grants the user the personal, non-exclusive, non-transferable and limited right to access and use the website.

Additional terms and conditions for products and services

The purchase of products or provision of services entail additional applicable terms and conditions, which should be understood as incorporated into these Terms of Use.

The user agrees to comply with such additional terms and conditions and also states, where required, to have reached legal age in order to use and/or participate in such services or features.

The Company’s obligations regarding its products and services are regulated solely by the contracts under which these products and services are provided, and nothing on this website may be construed as a modification of those contracts.

The Company reserves the right to change any product or service mentioned on the website, together with the prices for the products and services, at any time, without notice.

The material relating to products or services published on the site may include outdated information. The Company is not required to correct such material and has no liability in this regard.

Content on the website

Any text, graphics, user interface, visual interface, photography, trademark, logo, sound, music, illustration and computer code or other materials (collectively, “Content”) present on the site, including without limitation the design, structure, selection, coordination, expression, appearance and arrangement of such Content, belong to or are controlled or licensed by the Company and are protected by the laws on copyright, patents, distinctive signs and trademarks, as well as by the regulations on intellectual property rights and unfair competition.

The user may use the information made available by the Company on the condition that he/she refrains from copying or publishing the information on any networked computer or transmitting it by any means, does not alter the information in any way and does not issue any of type of statement or guarantee regarding the documents and information.

Use of the site by the user

In such cases, the Company reserves the right to block these illicit activities.

It is also prohibited to trace or attempt to trace the origin of information regarding any user or visitor to the site, or any of the Company’s customers, including Company accounts belonging to third parties.

The user agrees not to use any device or software to interfere or attempt to interfere with the proper working of the site or with any transaction conducted on it, or with the use of the site by third parties.

Pretending to be or represent other people and impersonating other individuals or entities is prohibited.

The user agrees not to use the site or its Contents for activities prohibited by law or by these Terms of Use, and to refrain from soliciting any activities that are illegal or infringe the rights of the Company or of others.

The user is solely and personally responsible for the use of the service, as well as for any adverse consequences that may affect the Company and third parties in relation to current civil and criminal legislation in Italy and to foreign legislation, where applicable.

The user agrees to:

1. not interfere with, destabilise or interrupt the service, the servers or the networks connected to the service, nor to act in contrast with any of the requirements, procedures or rules of the service;
2. not to use the service for any purpose that is unlawful or against public order, decency and morality;
3. not to use the service to transmit or distribute (including via links) any material that is illicit, pornographic, racist, invasive of privacy and/or otherwise obscene, vulgar (also if oriented towards an adult audience and featuring nudity or acts of a sexual nature), defamatory, calumnious or abusive, or, in any case, to send private information about a person without their consent in order to intentionally provoke emotional distress;
4. not transmit any material and/or messages that encourage third parties to implement misconduct and/or felonious behaviour subject to criminal or civil liability;
5. observe, and encourage individuals who use the service to observe, all the regulations, policies and procedures of the network connected to the service;
6. not to forge headers or otherwise manipulate distinctive signs or indications in order to disguise the origin of any content of the service or the service itself;
7. not to use or disclose content of the service that infringes any patents, trademarks, trade secrets, copyright or other industrial and/or intellectual property rights of the supplier or of third parties;
8. not to send any commercial and/or promotional messages or engage in “spamming” or “chain letter” activities or any other unauthorised forms of solicitation towards discussion groups, social forums or any other form of communication/aggregation, including “crossposting” and/or addresses of users who have no relationship with the sender; in particular, not to send unsolicited advertising via e-mail and/or mailbombing (sending multiple messages without significant changes in content to the same user), subscribe someone to a mailing list without that person’s permission, or attempt to enter a computer with a security system without authorisation;
9. not distribute viruses or any other technologies aimed at damaging the site or other users of the website;
10. not disclose information to third parties regarding the systems and methods of access to the service.

It is, in any case, expressly forbidden to use the service to directly and/or indirectly infringe the current laws of the Italian State or of other foreign countries.

The user can transfer the information provided by the service to other computers for personal use and, in any case, within his or her own business organisation.

The Company reserves the right to terminate access to the website, even for an individual user, if it deems, at its own sole discretion, that the site is being used in contravention of the above points.
